Terms of use

Using Sprout

By creating an account or using Sprout, you agree to these terms and to our privacy policy. If you don't agree, please don't use Sprout.

You must be at least 13 years old to use Sprout, or older if your country sets a higher minimum age for using online services without a parent's consent. If you are under 18, you need a parent or guardian's permission to use Sprout, and to buy Sprout Plus. The parent or guardian accepts these terms for you and is responsible for any purchase.

Your account

• Give a real email address you can access, and keep your password private. One account is for one person.
• You're responsible for what happens under your account. Tell us right away if you think someone else has used it.
• The name you choose is shown to people you share lists, families and templates with. Don't use a name that impersonates someone or is offensive.

Your content and sharing

Your lists, items, notes and templates belong to you. You give us permission to store, copy and display them only as needed to run Sprout, for example to sync them to your devices and show them to the people you share with.

• Lists: everyone in a list can add, change and remove its items. The list's owner can remove members, hand the list over, or delete it. Deleting a list, or deleting the owner's account, deletes it for everyone.
• Templates: anyone with a template's code can see its items and your name, and can make their own copy. Copies made by others stay with them if you delete the template.
• Only share content you have the right to share. Don't put sensitive personal information, such as health or financial details, in lists you share.

To report abuse, such as offensive content in a template, email support-sprout@mikrodev.net. You can always remove someone from a list you own, or leave a list. We may remove content or suspend accounts that break these terms.

Rules

Don't use Sprout to:

• break the law or violate other people's rights;
• harass anyone or share hateful, sexual, violent or otherwise harmful content;
• send spam or use Sprout for advertising;
• guess invite codes, get around CAPTCHA or security limits, or access lists you weren't invited to;
• copy, scrape, reverse engineer or overload the app or its servers, except where the law allows it.

Ads

The free version of Sprout shows ads provided by Google AdMob. We don't control each ad and aren't responsible for products advertised by others. The privacy policy explains the data used for ads and your choices.

Sprout Plus subscription terms

Plans and prices

Prices are in US dollars. Taxes may be added where required. Prices in an app store may be shown in your local currency and can differ. Sprout Plus currently removes ads and includes premium features as we add them. Features may change over time, but we won't take away "no ads" during a period you've paid for. Sprout Plus is not available for purchase in every country or through every channel.

Billing and renewal

• You're charged when you subscribe, and then automatically at the start of each new month or year at the price in effect, until you cancel.
• There is no free trial and no minimum commitment.
• For web purchases, we'll email you a reminder before each yearly renewal. We'll give at least 30 days' notice before any price change applies to you, and Apple or Google will also ask for your consent where their rules require it. If you don't want to pay the new price, cancel before your next renewal.
• After buying on the web, you'll receive a confirmation email that includes these terms and how to cancel.

Changing plans

For web purchases, switching between monthly and yearly, or between Just me and Family, takes effect right away, and time you've already paid for becomes credit toward the new plan. For App Store and Google Play purchases, the timing of plan changes follows Apple's or Google's rules.

How to cancel

• Bought on the web (Stripe): in Sprout, open the menu, tap Sprout Plus, then Change plan (family payers: Manage family) and choose Cancel on the billing page. You can also email support-sprout@mikrodev.net and we'll cancel for you.
• Bought through the App Store or Google Play: cancel in your Apple or Google account's subscription settings. We can't cancel store subscriptions for you.

Cancelling stops future charges. Plus stays active until the end of the current period. Deleting your account cancels a web subscription right away.

Refunds

Payments are non-refundable, including for partly used periods, except where the law requires a refund. If you think you were charged in error, email us and we'll look into it. Refunds for App Store and Google Play purchases are handled by Apple or Google under their own policies.

Family plans

• The person who pays manages the family and shares a family code. Members join with their own Sprout account.
• Members keep Plus while they're in the family and the family plan is active. If the payer removes a member, the member loses Plus right away. If the payer cancels, members keep Plus until the end of the paid period.
• Each member's lists and account stay their own. Joining a family doesn't share your lists.

App stores

If you downloaded Sprout from the Apple App Store, these extra terms apply:

• These terms are between you and us only, not Apple. We, not Apple, are solely responsible for Sprout and its content.
• Your license to use Sprout is limited to using it on Apple devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms.
• Apple has no obligation to provide maintenance or support for Sprout.
• If Sprout fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent allowed by law, Apple has no other warranty obligation for Sprout.
• We, not Apple, are responsible for handling any claims about Sprout, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
• If someone claims Sprout infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.
• You confirm that you're not in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties.
• Questions or complaints about Sprout go to us at the contact details below.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Sprout from Google Play, the Google Play Terms of Service also apply to your use of the store.

Ending your use

You can stop using Sprout and delete your account at any time. We may suspend or close accounts that seriously or repeatedly break these terms, or where the law requires it, and we'll tell you when we reasonably can. We may change or stop parts of Sprout. If we shut Sprout down, we'll give at least 30 days' notice and stop all renewals.

Disclaimers and limits of liability

We work hard to keep Sprout reliable, but it is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and we don't promise Sprout will always be available, error-free or that data will never be lost. Keep your own copy of anything important.

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim relating to Sprout is limited to the greater of the amount you paid us for Sprout Plus in the 12 months before the claim, or US$50.

Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under the mandatory consumer laws of the place where you live.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules. Disputes will be handled in the state or federal courts located in California, unless the law where you live gives you the right to bring a claim in your local courts. Before going to court, please email us so we can try to solve the problem informally.

Changes to these terms

We may update these terms. We'll change the effective date at the top and, for important changes, tell you in the app or by email before they take effect. If you keep using Sprout after the changes take effect, you accept them. Changes to subscription terms don't affect a billing period you've already paid for.
